BOOKING TERMS AND CONDITIONS

RESERVATIONS AND PAYMENT:


For any bookings, we require a non-refundable 30% deposit to secure reservations from our travel partners. This will be deducted from balance, which is due no later than 45 days prior to departure. All items are subject to availability. Air payment is due immediately upon confirmation.

 

Ehabla Travel d/b/a “E Habla Travel Trust” reserves the right to cancel reservations if payments are not paid when due. No one will be allowed to depart on a trip unless all payments and necessary documents have been received by EHabla Travel. Participants are responsible for bringing a valid passport and, if required, a valid visa. Participants are responsible for consulting their doctors regarding any medical precautions.


CANCELLATION/REFUNDS:
 

Deposits are fully non-refundable. Payments for air may or may not be refundable.


After final payment, refunds of your land portion are computed as follows based on date of receipt of written cancellation notice:

All changes are subject to a change fee plus any charges that will be levied to reissue tickets as a result

of incorrect information provided. Air tickets are not issued by Ehabla Travel. They may be non-refundable and may carry substantial penalties for changes or loss of tickets. Domestic tickets booked through Ehabla Travel that are not in conjunction with international air are issued in-country and are non-refundable.
 

Tour costs do not include items not clearly specified in the itinerary. Although Ehabla Travel will make every effort to adhere to this itinerary, on rare occasion it may be necessary to adjust arrangements. Should such adjustment be necessary, substitution will be made to the best of its ability and no refund will be made. Vehicles (including but not limited to automobiles, vans, buses, boats, bicycles, and aircraft of all sizes) used for transport will be the best available depending upon circumstances at time of tour operation. Vehicles are not owned by Ehabla Travel. Insurance provided with self-drive vehicles may be basic and not comprehensive.


ASSUMPTION OF RISK:
 

YOU ACKNOWLEDGE THAT THE ENJOYMENT AND EXCITEMENT OF TRAVEL TO THE COUNTRIES VISITED DURING THIS TRIP ARE DERIVED IN PART FROM THE INHERENT RISKS INCURRED BY TRAVEL AND ACTIVITY BEYOND THE SAFETY OF LIFE AT HOME OR WORK. YOU ACCEPT THAT AIR TRAVEL TO, FROM AND WITHIN THE COUNTRY TO WHICH YOU ARE TRAVELING, ESPECIALLY CHARTER FLIGHTS OR FLIGHTS ON SMALL PLANES, AND OTHER MEANS OF TRANSPORTATION ON GROUND OR WATER CARRY A RISK TO HEALTH AND LIFE.
 

LIMITATION OF LIABILITY:
 

You assume any and all risks associated with travel arranged by Ehabla Travel, including but not limited to those enumerated in the paragraph entitled “Assumption of Risk” above.


You agree that you, your heirs, legal representatives and/or family members will not make a claim against or sue Ehabla Travel for loss or injury arising out of such risks.
 

You understand that EHABLA TRAVEL ACTS SOLELY AS A BOOKING SERVICE for hotels, airlines/charter companies, ground transportation (cars,minivans and buses), water transportation, restaurants and/or other services and DOES NOT VOUCH FOR THEIR PRACTICES OR SAFETY MEASURES.

 

Each of these companies is an independent entity with its own management and is not subject to the control of Ehabla Travel. You agree that Ehabla Travel shall not be liable for, and you hereby release and hold Ehabla Travel harmless from, any delay, inconvenience, expense, illness, injury or death or damage to property occasioned through the negligence or default of any company or individual engaged in providing these services.


You agree that Ehabla Travel shall not be responsible for, and you hereby release and hold Ehabla Travel harmless from, additional expenses due to delay or any other loss or injury caused by:  weather; force majeure; war or civil unrest; terrorism; criminal acts; roads, trails, hotels or passenger conveyance of any kind; accident or illness; lack of access to means of rapid evacuation or availability of medical supplies; the adequacy of medical attention once provided; physical exertion for which you are not prepared; consumption of alcoholic beverages or drugs by persons not employees of Ehabla Travel; expenses incurred prior to, enroute to or following a trip; or other causes beyond the reasonable control of Ehabla Travel. You further agree that Ehabla Travel shall not be responsible for any incidental or consequential damages of any kind.


Any reference herein to the limitation of liability of Ehabla Travel extends to itsowners, officers, employees, agents, servants and representatives.
 

INSURANCE:


Ehabla Travel strongly recommends that all clients obtain a comprehensive travel insurance package including cancellation/interruption and emergency medical evacuation. Ehabla Travel offers clients the opportunity to purchase any travel insurance deemed acceptable in any country.


If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. This agreement sets forth the entire agreement of the parties and may only be changed or provisions waived by writing signed by both parties. This agreement shall be construed, enforced and governed according to the laws of Australia applicable to agreements made and to be performed in Australia.
